1. Zinni visited Royal Lincoln-Mercury to buy an automobile. The parties entered into an agreement that was evidenced by their filling in a written order form. The form contained the following language: "The order shall not become binding until accepted by the dealer or his authorized representative.?? Below the statement was an appropriate line for affixing the signature. The form was never signed. Zinni sued for delivery of the car. Judgment for whom and why?

2. Reserve Insurance Company sent out renewal notices to policyholders, with stamped return envelopes enclosed. Duckett mailed her renewal on the day that her policy would have expired. She suffered an accident the following day while the renewal was still in the mail. Reserve claims that Duckett?s acceptance did not occur until the renewal was received at its office after the accident. Was Reserve correct in this defense to Duckett?s claim? Explain.

3. Thompson and his wife inspected new mobile homes being demonstrated by Sunnyland Mobile Homes, Inc. They selected the one they wished to buy and gave the dealer their $600 check as a down payment. At a later date the Thompsons refused to sign a prepared purchase agreement, claiming that the price contained was different from the one posted on the mobile home unit when they made their $600 payment. The Thompsons brought suit to recover the $600 already paid. Did they recover the down payment? Explain.

4. Meister and Murphy proposed to purchase three grocery stores from Arden-Mayfair, Inc. Arden-Mayfair drew up a contract, listing the purchasers as the principals and their wives. Meister?s attorney unilaterally changed the contract, deleting the wives as parties to the agreement. Other changes were also made, after which the principals signed the agreement and returned it to Arden-Mayfair, Inc. Meister and Murphy sought enforcement of the contract that Arden-Mayfair claimed was void for want of an unqualified acceptance. Judgment for whom and why?

5. Miller, in Albuquerque, New Mexico, gave Kloepfer, a broker, a written offer for purchase of property owned by Mr. and Mrs. Pickett of Doylestown, Pennsylvania. Kloepfer relayed the offer by telephone. Shortly thereafter the Picketts wired Kloepfer that they accepted the purchaser?s offer. Miller sought to remove himself from the agreement, claiming that acceptance could be made only by the Pickett?s signing the purchase offer. The court was asked to decide whether a valid acceptance to sell was made. How would you decide this case?
