Please review the following facts of the case and the legal authority that I have located to determine the strength of Mr. Ebersol?s case. In preparing your memorandum, please consider the following issues: (1) is Mr. Ebersol guilty of shoplifting? (2) if Mr. Ebersol is guilty of shoplifting, what can his expected punishment be?

Facts: our client, john ebersol, was arrested for shoplifting from a local hardware store, Mr. Ebersol went to the store on Saturday, April 1, 199_, to purchase a Phillips head screwdriver instead of the Phillips head screwdriver that he needed. Since the cost of new screws is less than the cost of a new flat head screwdriver, Mr. Ebersol returned Sunday to the same store to purchase the proper screws for his new screwdriver. 2. In people v. Durant, 12 N.M.26, 55 P.200 (1901), the defendant shoplifted a brick from a lumberyard. Durant was detained by the store security guard for a period of two hours. The court held that because of the length of the detention, the security guard had violated the defendant?s rights. In a unprecedented move, the court stated that Durant was guilty, but because of the length of his detention, Durant should suffer no sentence, however minimal. This case has not been overturned to date.
