Essay Instructions: Analyze a question of education law from opposing points of view based on a real situation or it can be made up. Preferably something with discipline. The paper should not to be about an actual legal case nor a general report about a legal subject.

STRUCTURE OF THE PAPER

The paper follows much the same structure of the case outline except there are obviously no parties (since there is no litigation ??" yet) and no citation. So start with the . . .

I. FACTS- Information that occurred

I. Legal Question Presented - In the form of a question; applying facts to a legal source, usually the particular constitutional, statutory, regulatory, or contractual provision involved.

II. ANALYSIS OF THE QUESTION from each side’s perspective, citing at least three statutes, cases, nyc chancellors or ny state regulations, nyc uft contacts, etc. to prove your points

III. RESOLUTION ??" Based on the analysis, what would be the best course for you, as an educational administrator, to take?

Two pieces of advice in writing your papers: (1) Avoid being an advocate for a particular side. Give strong arguments for both sides! (2) In your analysis, start low on the Cascade and work upward. Chancellor’s Regulations and school policies are probably more relevant than some U.S. Supreme Court case or constitutional provision.
