The Case of John
John is a 26-year-old male who recently revealed to you that he is HIV positive. During one of your sessions, John indicates that he has been having unprotected sex with multiple partners because it helps him deal with his anxiety and fear. As his counselor, you know that John has a girlfriend, who, up to this point, remains unnamed. You find your conversations with John upsetting because you consider his behavior to be morally wrong. John explains that he feels he has been given a death sentence, but is comforted by the thought that not everyone he has sex with will end up being HIV positive. He rationalizes his behavior by equating it to a coping mechanism. John is seeking treatment for anxiety, and, for what he assumes to be depression.

1, The CEO of a large national food chain and the food chain were charged with violating Section 301(k) the Federal, Food, Drug and Cosmetic Act because certain of food chain’s warehouses were contaminated by rodents, and the conditions had not been remedied after warning. The CEO was aware of the incident and had been informed that one of the corporate vice presidents was investigating and correcting the problem. The CEO contended that he had no reason to distrust the vice president’s ability to remedy the problem, but he did concede that as chief executive officer he had ultimate responsibility for sanitation in the warehouses. The food chain but not the CEO, pleaded guilty. Attorneys for the CEO moved for a judgment of acquittal on the ground that ‘the evidence in chief had shown that CEO was not personally concerned in this Food and Drug violation’.

What will be the likely outcome of this case and why?



2. In Riegal v. Medtronic, 128 S. Ct. 999 (2008) and Wyeth v. Levine, 129 S.Ct. 1187 (2009), both decided by the Supreme Court within several months of each other, the product causing the injury was approved by the FDA after extensive premarket safety and efficacy review. Yet in Riegal, the Court held Federal law pre-empted state law, and in Levine, the Court held Federal law did not pre-empt state law.
