Title: Ethics state laws Indiana

Total Pages: 2 Words: 731 Works Cited: 3 Citation Style: MLA Document Type: Research Paper

Essay Instructions: State of Indiana
Provide a synopsis of your state's laws or credentialing regulation relative to the ethical dilemma suggested in the case study. Provided here:
The Case of John
John is a 26-year-old male who recently revealed to you that he is HIV positive. During one of your sessions, John indicates that he has been having unprotected sex with multiple partners because it helps him deal with his anxiety and fear. As his counselor, you know that John has a girlfriend, who, up to this point, remains unnamed. You find your conversations with John upsetting because you consider his behavior to be morally wrong. John explains that he feels he has been given a death sentence, but is comforted by the thought that not everyone he has sex with will end up being HIV positive. He rationalizes his behavior by equating it to a coping mechanism. John is seeking treatment for anxiety, and, for what he assumes to be depression.
I have attached a paper that goes through the dilemma and some of the state laws. This paper has to be just state laws as it pertains to this case study.
PLEASE, Complete the following:
• Identify your state's laws or credentialing regulation relevant to the ethical dilemma in the case study.
• Evaluate how the laws and credentialing regulation affect your analysis and resolution of the case study dilemmas. In addition to the those please address the following:
In the Case of John, there is one main ethical concern: Does a therapist practicing in your state have a Duty to Warn John’s potential sexual partners of his HIV status? Be sure to investigate: 1. Does the state of Indiana have a Duty to Warn provision at all? 2. If so, does it cover this type of threat to others, or only threats of homicide? 3. If this type of threat is covered, how do you go about warning the victims? Some states request that you report his HIV status to a center for disease control, rather than to the victims themselves. Thanks….

Essay Instructions: I would like to use the same previous writers, if possible.

Food and Drug Law ??"

Limit answers to 200 words. All questions weighted equally.

1, The CEO of a large national food chain and the food chain were charged with violating Section 301(k) the Federal, Food, Drug and Cosmetic Act because certain of food chain’s warehouses were contaminated by rodents, and the conditions had not been remedied after warning. The CEO was aware of the incident and had been informed that one of the corporate vice presidents was investigating and correcting the problem. The CEO contended that he had no reason to distrust the vice president’s ability to remedy the problem, but he did concede that as chief executive officer he had ultimate responsibility for sanitation in the warehouses. The food chain but not the CEO, pleaded guilty. Attorneys for the CEO moved for a judgment of acquittal on the ground that ‘the evidence in chief had shown that CEO was not personally concerned in this Food and Drug violation’.

What will be the likely outcome of this case and why?

2. In Riegal v. Medtronic, 128 S. Ct. 999 (2008) and Wyeth v. Levine, 129 S.Ct. 1187 (2009), both decided by the Supreme Court within several months of each other, the product causing the injury was approved by the FDA after extensive premarket safety and efficacy review. Yet in Riegal, the Court held Federal law pre-empted state law, and in Levine, the Court held Federal law did not pre-empt state law.

Why did the Court hold differently in these two cases?

3. Compare FDA Form 483 to FDA “Warning Letter”.

4. Briefly describe four (4) enforcement actions FDA can take in response to a violation of the FD&C Act.
