ESSAY PAPER DESCRIPTION:

Perhaps the three most renowned words in United States history are the words "We the people..." These three words begin the Preamble of the U.S. Constitution. In its entirety, the Preamble looks like this:

"We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America."

The Preamble to the U.S. Constitution explains the purposes of the U.S. government. They are to:

• form a more perfect union
• establish justice
• insure domestic tranquility
• provide for the common defense
• promote the general welfare
• secure the blessings of liberty

Chief Justice of the U.S. Supreme Court William H. Rehnquist has said that there is some truth to the legal maxim inter arma silent leges, which means in time of war the laws are silent. Historically, this has applied when the U.S. has been at war with its external enemies, but sometimes also in cases of civil disturbance where extrajudical force may supercede the ordinary process of law (for example, during the Civil War).

Using the Preamble to the U.S. Constitution as your compass, investigate the literature available regarding civil liberties in the U.S. during time of war or domestice disturbance (or insurrection). Draw a conclusion as the the federal government's historical record of non compliance with the demands of the Constitution during these national emergencies.

National emergencies: Civil War, WWI, Japanese-American internment camps during WWII, Vietnam conflict and up to today's War on Terrorism.
