This disposition is awfully fearful in any community; and that it now exists in ours, though grating to our feelings to admit, it would be a violation of truth, and an insult to our intelligence, to deny.” Through a careful analysis of Lincoln’s speech (be sure to look at the Jaffa piece), explain what the real dangers of civil disobedience are according to Lincoln. #2-2) While not explicitly mentioned by name in the Letter from a Birmingham Jail, Martin Luther King credits Henry David Thoreau for designing the architecture of his civil disobedience campaign: "I became convinced that non-cooperation with evil is as much a moral obligation as is cooperation with good. No other person has been more eloquent and passionate in getting this idea across than Henry David Thoreau. As a result of his writings and personal witness, we are the heirs of a legacy of creative protest." – (Autobiography). Thoreau’s letter is also written on the basis of his experience of being imprisoned for refusing to pay taxes that would have contributed to the deployment of soldiers in the Mexican War. Reflecting on our obligation to law, Thoreau explains: “Law never made men a whit more just; and, by means of their respect for it, even the well-disposed are daily made the agents of injustice.” Explain the reasoning of Henry David Thoreau’s argument for civil disobedience and his general understanding of our obligation to law. Do you think that King would subscribe to Thoreau’s reasoning. What lessons about our obligation to law do you draw from this comparison?

1. Many of you expressed some reservations about King’s claim that his followers are entitled to break laws they determine to be unjust. In response to a similar concern of the clergy, King attempts to justify his actions on the grounds that it is possible for human beings to determine the justice of a law independently of the decisions of a democratic majority. On behalf of his position, he cites a famous line from St Augustine who wrote a fictional dialogue with the character Evodius on the free will. The line can be found at the end of the following quote from the Letter from a Birmingham Jail:



“You express a great deal of anxiety over our willingness to break laws. This is certainly a legitimate concern. Since we so diligently urge people to obey the Supreme Court's decision of 1954 outlawing segregation in the public schools, at first glance it may seem rather paradoxical for us consciously to break laws. One may well ask: "How can you advocate breaking some laws and obeying others?" The answer lies in the fact that there are two types of laws: just and unjust. I would be the first to advocate obeying just laws. One has not only a legal but a moral responsibility to obey just laws. Conversely, one has a moral responsibility to disobey unjust laws. I would agree with St. Augustine that "an unjust law is no law at all."



Carefully analyze Augustine’s dialogue with Evodius and the excerpts from the City of God, and explain why Augustine argues that for Christians “an unjust law is no law at all.” Do you think that Christian Jurisprudence as illustrated here offers a sound foundation for democratic politics. Consider King’s use of this jurisprudence in his letter.





2. In discerning the difference between just and unjust laws, Martin Luther King explains:



“Now, what is the difference between the two? How does one determine whether a law is just or unjust? A just law is a man made code that squares with the moral law or the law of God. An unjust law is a code that is out of harmony with the moral law. To put it in the terms of St. Thomas Aquinas: An unjust law is a human law that is not rooted in eternal law and natural law.”



Explain the structure of law according to Aquinas (note that law is divided into 4 types). What are the types of law and how do they relate to one another. Does Aquinas account of the cosmic order of law (the 4 types) provide a useful framework for King’s claim that it is possible for human beings to know the justice of law without having to defer to majority rule? Having read Aquinas general account of law, What do you think that King means by the statement “an unjust law is a human law that it not rooted in the eternal and natural law.”
