PROPOSAL : Presented to professor for approval.

I would like to propose a paper on the doctrine of stare decisis. I will define stare dicisis and discuss its history. This will include its origine, Latin roots, and how it came to be a doctrine of western law.
I will discuss opinions of stare decisis that do not approve of this doctrine. There are those who have the opinion that previous cases have been hastily decided. Some cases may not have had proper representation through incompetant lawyers. Stare decisis is out dated, the previous cases can in no way account for the complexity of current cases. Todays far advanced technology was not even thought of during the inception of stare decisis.
There is also controversyas to whether stare decisis is more good than bad. There are those who justify the docterine with arguments which focus on the desirability of stability and certainty in law which brings about justice and fairness. They argue that there should be a sense of fairness in the judicial system where those cases should be dicided the same today as tomorrow, when the facts are the same and whether you are plantiff or the defendant. They argue that stare dicisis expedites the flow of cases through the judicial system. Without stare decisis the judicial would shut down from repetitive cases.
I will form an opinion as to which arguement I am in agreement with through my research of such materials as periodicals, text books, internet material with legitimate foundation, any documentation though newapaper articals, as well as any other publications with legitimate documentation, ECT..

Professors notes on proposal were: Focus on as to whether stare decisis is more good than bad. Stare Decisis is a judicial discretion constraining device. Is high levels of judicial discretion good or bad. Focus on this.
