no longer than 1 pg. case brief on Lujan v Defenders of Wildlife (1992)
Facts: 2-3 sentences about the case. The facts are simple to provide some quick context for the issue
Issue: this is the most challenging part -Should be only the main issue that focuses on the administrative law part (Control of the Bureaucracy). Short & to the point
Decision: if any....also a simple statement
Reasoning: why the majority justices decided the way they did
Dissenting: If decision is split .why./and include a sentence or two of the rational for the opinion. If Unanimous decision then ignore this part.
Analysis: a concluding analysis....your opinion...did you agree with the majority or dissenting and why...

1a. Can you make an arguement for standing and why is standing important?

1. Do you believe iron triangles are a detriment to democracy or necessity for efficient and effective policy? Are interest groups representative of the public or representative of the ?big wallet? public?

2. Whitman v American Trucking: Do you think the language used in the Clean Air Act sufficiently limits the EPAs discretion in setting air quality standards? Given the technical nature of setting air quality standards, would it be possible for Congress to be more specific?

3. Benzene Case: The legislative branch gave discretionary power, in which cost-safety would have to be considered by the administrative agency ? was this an over-delegation of power or a necessity to provide health experts set an adequate standard? Does Congress lack the expertise to be more specific?

4. INS v Chadha: Do you agree that the practice of a legislative veto is necessary? Or do you feel if Congress chooses to exert their power, they must do so from the onset and make critical, yet explicit policy through the Acts they pass?

5. FDA v Brown: Did you agree with the Court?s decision? Has tobacco finally met its match with recent (2009) legislation allowing FDA to regulate tobacco?

4. There are times where legislative veto is essential and serves the purpose of keeping the two houses in balance. Without it, the bicameral system would not properly function.

5. I do agree with the court's decision. There are already federal laws in place limiting the legal smoking age, any further government intrusion is going too far. Tobacco has not met its match. The FDA only has the power to regulate purity and quality of the products. While this does add an extra burden onto the manufacture of tobacco products, it does not limit their ability to run the business.
